Terms of Service

You must be at least 18 years of age to purchase or use the Service. By accepting these Terms you represent and warrant that you meet this requirement.

Spectra is a hardware-isolated computer-vision assisted input system that operates entirely on a dedicated secondary device via external HDMI capture. The Service does not install any software, driver, or process on your primary gaming machine.

Access to the Service is granted upon successful payment and is subject to the plan or subscription tier you purchased. We reserve the right to modify, update, or discontinue any feature of the Service at any time without prior notice.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Resell, sublicense, or redistribute access to the Service without prior written consent.
• Attempt to reverse-engineer, decompile, or extract the source code of any component of the Service.
• Share, transfer, or disclose your account credentials to any third party.
• Use the Service in any manner that could damage, disable, or impair our infrastructure.
• Circumvent any technical or access-control measures we implement.

Violation of this section may result in immediate suspension or termination of your access without refund.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately upon becoming aware of any unauthorized use. One license is valid for one person and one active hardware setup at a time unless otherwise stated in your plan.

All prices are listed in United States Dollars (USD) unless otherwise stated. Payment is processed through our third-party payment provider. By completing a purchase you authorize the charge for the amount stated at checkout.

Subscription plans (where applicable) renew automatically at the end of each billing cycle unless cancelled before the renewal date.

All sales are final. We do not offer refunds, credits, exchanges, or pro-rated reimbursements for any reason, including but not limited to:

• Change of mind or no longer wanting the product.
• Inability to meet the hardware requirements listed on the product page.
• Account suspension or ban issued by a third-party platform or game publisher.
• Failure to read or understand these Terms prior to purchase.
• Partial use of a subscription period.

Please review all product requirements and documentation carefully before purchasing. If you have pre-sale questions, contact us via our Discord server before completing your order.

Initiating an unauthorized chargeback or payment dispute is a material breach of these Terms and will result in permanent termination of your licence and ban of your HWID (Hardware ID). We reserve the right to contest all fraudulent chargebacks and provide transaction evidence to the relevant payment processor or issuing bank.

All software, algorithms, models, designs, text, and other content comprising the Service are the exclusive property of Spectra and are protected by applicable intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for personal use only. No ownership is transferred.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECT WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPECTRA AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

We may suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason. Upon termination, the No Refund Policy in Section 6 continues to apply.

We reserve the right to modify these Terms at any time. When changes are made, we will update the effective date above. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws applicable to the jurisdiction in which Spectra operates, without regard to conflict-of-law principles. Any disputes shall be resolved through binding arbitration or in the courts of our operating jurisdiction.
